The Contract

Vacation Rental Agreement

​

1.     Agreement: Renter must be at least 25 years to book and check-in; and must be present for the entire stay. The Premises are for the sole use as a personal vacation accommodation for the individuals listed on this rental agreement. NO PARTIES OR GATHERINGS of any kind are allowed.  

2.     Reservations and Payments: Reservation payments are handled at check out. The Premises will not be held for Renter until deposit and signed contract are received. Rental property can accommodate up to 10 guests. 6 adults, and 4 children.  

3.     Arrival and Departure: Check-in is AFTER 3:00PM; Check-out is NO LATER than 11:00AM. Early check-in time of 8:00am on day of arrival is available for $100 with pre-approval. Late check-out time of 5:00pm on day of departure is available for $100 with pre-approval. Unapproved late check-outs will be charged the daily rate. Holding over shall be subject to a charge at double the daily rate.  

4.     Cancellation Policy: Cancellations received 60 days or more prior to check-in will receive 50% refund. Cancellations received less than 60 days before check-in will not receive a refund. Renters have the option to purchase travel insurance through www.vacationrentalinsurance.com, www.insuremytrip.com or any other travel insurance company.  

5.     What to Bring:  Your personal toiletries. Food, if you plan to cook. (Wonderful grocery store less than a mile away)  

6.     No Smoking: Smoking of cigarettes, e-cigarettes, cigars, pipes or any other substance is strictly prohibited on the Premises (including decks, patios and driveway). If there is any evidence of smoking (i) Renter is responsible for all damage, (ii) Renter is in breach of this Agreement; (iii) Renter, Authorized Guests, and all others may be required to immediately leave the Premises, or be removed from the Premises; and (iv) Renter forfeits their right to return of security deposit.  

7.     No Animals: Animals are prohibited. If animals are brought onto the property (i) Renter is responsible for all damage, (ii) Renter is in breach of this Agreement; (iii) Renter, Authorized Guests, and all others may be required to immediately leave the Premises, or be removed from the Premises; and (iv) Renter forfeits their right to return of security deposit. Strict policy  due to the wildlife here in the mountains.       

8.     Renter Responsibilities: Renter shall upon arrival examine the Premises, and shall report within 24 hours if any items are not in operable condition, are in disrepair. Please let us know within 30 minutes if the cabin was not sufficiently cleaned. Renters and/or their guests must abide by all terms of use, all pertinent local ordinances and laws. Renter will not use Premises for any commercial use including filmmaking or photo shoots. Upon termination of occupancy, Renter shall: vacate the Premises and surrender it to Owner empty of all persons; also vacate any/all vehicles.

9.     Garbage: Bring all of your trash to the transfer Station in Avery.  Just a 4-minute drive from the cabin.  It is free to dump household waste. 4541 Segale Rd, Avery, CA 95224.   Failure to take trash upon checkout will result in Renter forfeiting their right to return of security deposit.

10.  Damage: Renter is responsible for any damage caused either inside, or outside the cabin property.  

11.  Parking: Small RV’s and small trailers are allowed. Renter assumes the risk for parking violations, if blocking street or driveway. We have a long driveway with plenty of parking.  Street parking is not permitted. (no cleanout or dumping facilities available) 

12. Road noise: The cabin is located adjacent to Highway 4. Some road noise should be expected. Road noise does not constitute a refund of any kind. 

Quite hours start at 10pm, per the Calaveras County code.

13A.  Security Systems: The Premises are equipped with 3 exterior security cameras. Cameras are installed primarily as a theft deterrent and to monitor wildlife. Security cameras are not monitored and should not be relied on for personal safety. No cameras are placed inside, or with any view of the interior of the property. Security cameras may be used to verify compliance with rental policies.  Alexa devices are used for clock/music and may be unplugged by our guest.

13B. Safety: No camp fires, Do not use the indoor log fireplace, no food left in your vehicles or outside (bears, and other large animals) Do not enter the out buildings.

14.  Maintenance: Renter shall properly use, operate and safeguard the Premises including, any landscaping, furniture, furnishings, appliances, and fixtures. Renter shall immediately notify Owner, or Owner’s Representative of any problem, malfunction or damage. Renter shall pay for all repairs or replacements caused by Renter or Renter’s guests. Renter shall pay for all damage to the premises as a result of failure to report a problem, or malfunction in a timely manner  

15.  Owner or Agent Entry: Owner and Owner’s agents have the right to enter the Premises, with reasonable notice (i) for the purpose of making necessary or agreed repairs, decorations, alterations, improvements, or maintenance or to supply necessary or agreed services; (ii) to verify the Renter has complied with the terms of this Agreement; or (iii) in case of emergency.  

16.  No Assignment or Subletting: Renter shall not assign any interest in this Agreement or sublet any part of the Premises. If this Agreement is assigned or the Premises or any part thereof is sublet, (i) Renter, Authorized Guests, assignee(s), sub-lessee(s) and all others may be required to immediately leave the Premises or be removed from it; (ii) Renter is in breach of this Agreement; and (iii) Renter forfeits their right to return of any rent or security deposit.   17.  Possession: If for any reason, the Premises cannot be delivered to Renter on the agreed date(s), either party may terminate this agreement. It is acknowledged that either party shall have no liability except that all sums paid will be refunded to Renter. Owner will not be liable for any other damages whether direct, indirect or consequential.  

18.  Prohibited Items: The following items are prohibited from being brought, stored or used on the premises: fireworks; weapons of any kind; Pellet guns; explosives; other hazardous materials.  

19.  Mediation: Renter agrees to mediate any dispute or claim arising out of this Agreement, or any resulting transaction, before resorting to arbitration or court action. Mediation fees, if any, shall be divided equally among the parties involved. If Owner consults or engages legal counsel or a professional collection service, for collecting any amounts due to Owner under this Agreement, Renter shall be responsible for all costs of litigation and/or collection in case of such, including actual attorney’s fees.    

20.  Indemnification: Renter agrees to release and indemnify Owner from and against all liability should anyone be injured upon the premises during the term of occupancy, resulting from any cause whatsoever, except in the case of personal injury caused by willful gross negligence on the part of the Owner. Renter’s or Renters guests' personal property, including vehicles, are not insured by Owner against loss or damage due to fire, theft, weather, or any other cause. 

21.  Waiver: The waiver by either party hereto of a breach of any term or provision of this Agreement shall not operate or be construed as a waiver of a subsequent breach of same provision by any party or of the breach of any other term or provisions of this Agreement. Headings of the paragraphs herein are used solely for convenience and shall not be used for interpretation or construing any word, clause, paragraph or provision of this Agreement.  

22.  Invalid Provisions: If any provision of this Agreement is held to be illegal, invalid or unenforceable under present or future laws effective during the term hereof, such provision shall be fully severable and this Agreement shall be construed and enforced as if such illegal, invalid, or unenforceable provision had never comprised a part hereof; and the remaining provisions hereof shall remain in full force and effect and shall not be affected by the illegal, invalid, or unenforceable provision or by its severance hereof.

Furthermore, in lieu of such illegal, invalid, or unenforceable provision there shall be added automatically as a part of the Agreement a provision as similar in terms to such illegal, invalid, or unenforceable provision as may be possible and still be legal, valid, or enforceable.

22.  Entire Agreement: Not withstanding any other assurance to the contrary, this Occupancy Agreement is not binding or effective until signed by Guest, and accepted by Owner as evidenced by Owner’s acceptance of deposit payment. This Agreement sets forth the entire understanding of the parties and supersedes all prior agreements or understandings, whether written or oral, with respect to the subject matter hereof. No amendment or modification hereto shall be binding unless made in writing and signed by the parties hereto. Every effort is made to ensure all information on the web site and other documentation is accurate and complete.

However, Owner is not liable for errors, omissions, mistakes, price changes and any changes by the Owner in furnishings, equipment, bed arrangements and other accommodations.  

RENTAL RATES: Rental rates are $750 per night, and up. (see rental fee tab for more info) 3 night minimum. Maximum occupancy is limited to ten persons overnight. Any overnight guest not listed on the rental agreement will result in a charge of $100 per person, per night. DEPOSIT: A security/damage deposit of $375 is due when booking. It will be returned within 7 days if no damage is found, or none of house rules are broken.  

CLEANING FEE: A fee of $245 for cleaning is due at the time of your reservation. This fee includes washing and sanitizing all linens. Including sheets, towels, kitchen hand towels, emptying the dishwasher and a deep clean of the entire cabin. Just load dishwasher, turn thermostat off, take your trash, and lock the door when you leave. We will do the rest.

By signing this Agreement, you certify that you have read and agree to all terms and conditions in the contract; and agree to follow all house rules. Renters must return completed and signed documents before welcome package and door access codes will be issued.

The Premises will not be held for Renter until deposit payment and signed contract are received. Renters have the option to purchase travel insurance through www.vacationrentalinsurance.com, www.insuremytrip.com or any other travel insurance company. No refunds are given for illness, road closures, weather, fire, or any other reasons beyond owner’s control. Any changes must be submitted in writing prior to check-in.

Early check-in time of 8:00am on day of arrival is available for $100 with pre-approval.

Late check-out time up to 5:00pm on day of departure may be available for $100 per hour, with preapproval.
